Terms of Service

Disclaimer: If you are not a current owner of my artwork and you repost, edit, trace, copy, or sell any part of my artwork in any shape, way or form without my written permission. You will be immediately blacklisted, are at risk for being posted on Artist Beware and have possible legal action taken against you.

By Commissioning me you are automatically agreeing to the following rules.

  • Should any Terms of Service be breached, or I incur damages caused by the client, I reserve the right to either issue a takedown DMCA notice or pursue damages through the Copyright Law of the United States.

  • I reserve the right to refuse any commission from anyone for any reason.

  • Any rude or inappropriate behavior will result in an immediate block and blacklist from all future commissions.

  • Style of Commissions might change as my art style develops, be prepared for this when commissioning me.

  • You will always receive a sketch for approval before I move on to finishing the piece. The only situations I will show WIPs during the process is; if they are requested by the buyer, the buyer is purchasing a custom design or I myself have questions about the artwork that need to be solved.

  • Commissions may take anywhere from a few days to a few months to complete. If you need the commission by a certain time, tell me in advance. I will let you know upfront how long the commission will take. Please be patient and wait, if you have concerns always message me.

  • These rules are subject to change over time. Please reference back if something is different.

  • You must be 18 years old if you are commissioning NSFW art from me. I will require you to prove you are 18+ as well before accepting the commission.

Upon receiving a commission, the client may;

  • Use the artwork for personal use only such as an icon or avatar.

  • Upload the artwork to a private gallery with proper credit to me (Social Media listed in the main section).

  • If the client would prefer that I do not post the finished artwork publicly, they can request a private commission.

Upon receiving a commission, the client may NOT;

  • Use the image for commercial use to generate income

  • Edit out my signature/watermark from the original image

  • Trace/Copy/Make Bases out of the artwork

  • Any form of reproduction of the artwork, including any blockchain-related endeavors or NFTs!

  • Claim the artwork as their own original creation regardless of how the image has been edited by them

  • Post the HD version unless they want to risk their personal artwork being stolen

  • I, the artist, retain all legal and artistic rights to the artwork itself, and post the artwork in any gallery or portfolio for self-promotion with credit to the client for the character.

  • All prices listed are in USD. Only USD will be accepted as payment. Any other currency will NOT be accepted.

  • Full payment is due upfront through Venmo/Cashapp or Paypal. Please have your payment ready when submitting an application for a commission.

  • Payment must be received within 24 hours of the commission being accepted or your slot will be forfeited to the next person.

  • For any commission, I will send an image of a sketch before completion. Any changes must be requested at this stage; changes requested after the sketch phase will incur additional costs. If I have further questions I will send WIPs throughout the process as needed to make sure the commission is correct.

  • I will never make commercial use of a commissioned piece.

  • The client may not use the artwork for any commercial purposes (including the sale of merchandise, self-promotion, or for increasing the value of a character design).

  • If the client wishes to use the artwork for commercial purposes, it must be discussed with me before the artwork is completed and will add on a charge of 200% of the original commission cost.

  • All artwork comes with simple coloured Backgrounds. Scene or Complex backgrounds are a 75% to 90% of commission price upcharge based on the price depending on the desired complexity. (Offer is 40 + 30 upcharge = 90 total)

  • If a Custom Character is purchased, the details of the design should be credited to me. After you own the character you are free to alter the design. However the original must be credited to me.

  • After the Purchase is complete, it cannot be refunded. Unless I, the artist, make the decision I can no longer do the commission. If you find yourself unhappy with the commission you have received, you can contact me and we can discuss a solution.

Anyone caught breaking the TOS will be contacted with a warning message. Depending on the severity of the case the rule-breaker may also be blocked, blacklisted, have their slots revoked, or have their commission canceled entirely.Breaking T.O.S. with the intention of causing harm, drama, or instigating issues will result in further legal action as necessary. This is only in a severe or a serious case.

WHAT SOFTWARE/ART PROGRAMS DO YOU USE FOR YOUR ART?
I use Paint Tool Sai 2 for all my standard art. I use Aseprite and Krita for all Pixel / Animations!DO YOU USE A MOUSE? DRAWING TABLET? IPAD?
I use an EX PEN Artist Pro 12 to do all of my artwork. Occasionally I draw with my mouse for very minor things!DO YOU STREAM? IF SO WHAT IS YOUR SETUP?
I have a fully custom PC with a Hyper X Microphone, Corsair Keyboard, Steel series Mouse, my tablet and I also use Streamlabs OBS when I stream.

WHAT ARE YOUR BRUSH SETTINGS? WHERE CAN I FIND THEM?
At this time, I like to keep my settings private. Though I will say I use a lot of the basic brushes from Paint Tool Sai 2 with some settings altered to better fit the style I am looking for! I also do use texture brushes created by Raikairan!CAN I COPY YOUR ART STYLE? MAY I TRACE YOUR ART?
No. You can take inspiration as long as there is credit given. COMMISSIONS / INQUIRES

HOW LONG DO COMMISSIONS TAKE?
Roughly 1 week to a few months depending on exactly what you are getting and where you are in the queue. If my queue is empty, you could get your artwork sooner than if it's full.MAY I GET A TATTOO OF ART YOU CREATED FOR ME?
If that is what you choose to do with it, I would be happy to see the end result and I would be honoured you wanted to do something like that of a piece I made you.DO YOU TAKE REQUESTS?
At this time and for the foreseeable future, I will not take art requests unless I post that I am. Art Requests are not my priority and will be the last thing I do if I have a full queue.DO YOU DO ART TRADES?
Yes, only with my partner or closest friends. I will also do art trades with artists who I admire.

If you would like to draw fanart of my character you are more than welcome to. If you do, please tag me in it, I would love to see what you created!Please do not draw my character with yours for my own safety and comfort. No. You may not use/steal/claim ownership/trace/reference or take my character for any reason. The only reason you may use my character is fanart.HOW DO I CONTACT YOU?
